SurfEye — Terms of Use
Welcome to SurfEye, operated by SurfEye AB (“SurfEye,” “we,” “us”). These Terms are a legal agreement between you and us governing your use of the SurfEye apps and website, our content (including webcams and ratings), and any related services (the “Service”). By using the Service you agree to these Terms.
1) Who may use SurfEye
- You must be at least 13 years old (or the minimum age of digital consent in your country). If you are under 16 in the EEA/UK you must have parental consent.
- You will create and maintain one account per person and keep your credentials secure.
- Business use (e.g., embedding or re-broadcasting SurfEye content) requires our prior written permission.
2) Your account, plans & billing
- Accounts are required to save favorites, settings, and to enable alerts across devices.
- Plan limits currently enforced (subject to reasonable changes with notice in-app):
- Free: 7 days or 20 webcam views total (whichever first)
- Basic: 15 webcam views/month
- Premium: Unlimited webcam views
- Paid plans auto-renew until cancelled in Profile → Manage Account. We may change prices for future periods with advance notice.
- EU/UK consumers: if you buy directly from us, you have a 14-day withdrawal right. By starting Premium features during that period, you request immediate performance and acknowledge losing that right for the current period. You can still cancel renewal at any time.
- Taxes may apply depending on your location. Unpaid amounts may lead to suspension.
3) License & acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial surfing decisions.
You agree not to:
- scrape, record, download, re-stream, rebroadcast, or mass-archive webcam streams or thumbnails;
- bypass plan limits, rate limits or access controls;
- reverse engineer, alter, or frame the Service; inject malware; or use the Service to develop a competing dataset;
- upload unlawful content, infringe others’ rights, or use the Service where prohibited.
4) Webcams, third-party content & links
Some webcams are owned by third parties and made available via their terms. We do not guarantee availability, quality, or accuracy. Removal may occur at the request of an owner or if licenses change.
5) Ratings & safety
The 1–5 rating is an estimate based on swell, wind, tide and spot metadata. It is guidance only. Ocean conditions change quickly and may be dangerous. You surf at your own risk; always follow local regulations and lifeguard guidance.
6) Service changes & availability
We may add, remove, or modify features, plans, and limits. We strive for high availability but the Service may be interrupted for maintenance, network, or third-party issues.
7) Ownership & feedback
We and our licensors own all rights in the Service and our content. You grant us a worldwide, perpetual, royalty-free license to use feedback you choose to submit (e.g., spot corrections) to improve the Service.
8) Termination
You may stop using the Service at any time and can delete your account in Manage Account → Delete account. We may suspend or terminate access for material breach (e.g., abuse, scraping, non-payment) or to comply with law.
9) Disclaimers
THE SERVICE IS PROVIDED “AS IS”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
10) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD (OR €50 IF YOU USED THE FREE PLAN).
Consumer law preservation: Nothing in these Terms limits rights you cannot waive (e.g., statutory consumer rights).
11) Indemnity
You will indemnify and hold SurfEye harmless from third-party claims arising from your unlawful or unauthorized use of the Service.
12) Governing law & disputes
These Terms are governed by the laws of Sweden, without regard to conflict-of-laws rules. Courts of Uppsala, Sweden have non-exclusive jurisdiction. If you are a consumer, mandatory consumer protection rules of your country of residence still apply.
13) Changes to these Terms
We may update these Terms. When we materially change them, we will notify you in-app or by email and state the new effective date. Continuing to use the Service after the effective date means you accept the new Terms.
